Mediation or court? How to choose
Most families never need a trial. Here is how to tell which path fits your situation.

Marisol Vega

Filing for divorce does not mean you are on the path to a trial. Most cases settle, and many settle in mediation.
Mediation suits you if
You can both talk honestly about money and the children, and neither of you is afraid of the other.
Court may be needed if
There has been abuse or control, one person is hiding assets, or the other side refuses to take part.
A middle path
Collaborative divorce gives each of you your own lawyer while everyone commits to settling. It suits couples who want advice at every step.
This guide is general information about family law in Oregon and Washington. It is not legal advice for your situation, and reading it does not make us your lawyers. Laws differ by state and change over time.
Key points
Mediation works when both people can negotiate safely
Court is right when there is risk or a refusal to engage
You can start in mediation and still go to court
